This service is in preview. butterdraw.com is an
early-stage, evolving product offered free of charge. Features may change,
break, or be removed without notice. Expect bugs, interruptions, and rough
edges, and do not rely on it for anything important.
These terms are an agreement between you and ButterDraw.com
(“ButterDraw”, “we”, “us”, “our”), the operator of the butterdraw.com service
(the “service”). By using the service you agree to them. You can reach us
through the in-app Support & feedback button.
1. Preview / “as-is” service
The service is provided on an “as is” and “as available”
basis, without warranties of any kind, whether express or implied — including
but not limited to merchantability, fitness for a particular purpose,
reliability, availability, accuracy, or non-infringement. We do not promise
that the service will be uninterrupted, secure, error-free, or that any data
you create will be preserved.
2. Your data and backups
You are responsible for keeping your own copies of anything you value.
Diagrams, accounts, shared links, and any stored content may be lost,
corrupted, reset, or deleted at any time. Use the export options
(JSON, PNG, PDF, Mermaid, HTML) to back up your work. We are not responsible
for any loss of data.
3. Limitation of liability
To the maximum extent permitted by law, we accept
no responsibility or liability for any problems, damages,
losses, or costs of any kind arising from your use of — or inability to use —
the service. This includes, without limitation, lost data, lost work, lost
profits, business interruption, or any direct, indirect, incidental, special,
consequential, or punitive damages, even if we have been advised of the
possibility of such damages. You use the service entirely at your own risk.
Nothing in these terms excludes or limits liability that cannot be excluded or
limited under applicable law, including the Business Practices and Consumer
Protection Act (British Columbia) or liability for fraud or for death or
personal injury caused by negligence. Where liability cannot be excluded, our
total aggregate liability to you is limited to the amount you paid us for the
service in the 12 months before the claim (which, for the free preview, is nil).
4. Acceptable use
Don’t use the service for anything unlawful, abusive, or harmful; don’t try to
disrupt, overload, reverse-engineer, or gain unauthorised access to it or to
other users’ content; and don’t upload content you don’t have the right to use.
We may suspend or remove access at any time, for any reason, without notice.
5. Changes to these terms
These terms may be updated as the service evolves. If they change in a
meaningful way, you’ll be asked to review and accept the updated terms before
continuing. Continued use after an update means you accept the revised terms.
6. Governing law
These terms are governed by the laws of the Province of
British Columbia, Canada and the federal laws of Canada that
apply there, without regard to conflict-of-law rules. You and ButterDraw agree
to the exclusive jurisdiction of the courts located in British Columbia, subject
to any non-waivable rights you have under the consumer-protection laws of the
place where you live.
7. Acceptance
By ticking the box below and continuing, you confirm that you have read,
understood, and agree to these Terms of Service and the Privacy Policy below,
and that you understand the service is an experimental preview offered without
warranty or liability.
Privacy Policy
This policy explains what information ButterDraw collects, why, and your
choices.
P1. Telemetry & troubleshooting information
To keep the service working and to diagnose problems — especially while
it is in preview, when we rely on this to find and fix issues quickly —
we collect diagnostic and usage information, including:
- Error and crash reports — JavaScript errors, failed
requests, and related technical details.
- Usage and feature events — e.g. which tools and shapes you
use, diagrams created/opened/saved, exports, AI calls, share links, and
collaboration joins, plus aggregate per-day counts.
- Performance timings — how long actions such as saving,
activation, and AI calls take.
- Interaction diagnostics — a time-ordered stream of
pointer, viewport, and selection events used to reconstruct what happened
in a session for troubleshooting. We do not record a video of your screen.
- Device/session basics — such as browser type, screen size,
and a session identifier.
- Referral / campaign tags — UTM parameters present on a link
you followed to reach us.
P2. Information you provide
- Support requests — the message, screenshots, and logs you
attach when you contact support.
- Collaboration — the name and email you enter to join a
shared diagram.
- Premium — the email associated with a premium token.
- Your diagrams — content you save to the cloud (premium).
Where you enable end-to-end encryption, diagram content is encrypted in your
browser before it reaches us and we cannot read it.
P3. How we use it
We use this information to operate, secure, maintain, debug, and improve the
service, to understand which features are used, to respond to support requests,
and to prevent abuse. During preview we may collect more diagnostic detail than
we expect to keep long term, and we will reduce it as the service matures.
P4. Sharing & storage
Data is stored on our cloud infrastructure (Microsoft Azure). We may share it
with service providers who host or process it on our behalf, or where required by
law. Data may be processed in Canada and other countries.
P5. Retention
Telemetry and session diagnostics are automatically deleted on a rolling basis
(by default after about 90 days). Aggregate counts that contain no personal
information may be kept longer. Content you save is kept until you delete it or
your account/diagram is removed.
P6. Your choices
We honour your browser’s Do Not Track / Global Privacy Control
signal and stop diagnostic capture when it is set. You can ask us to access or
delete your personal information, or ask a privacy question, through the in-app
Support & feedback button.
P7. Changes to this policy
We may update this policy as the service evolves; meaningful changes will be
surfaced for you to review, as with the terms above.
